Covenants
Covenants are private arrangements between property owners. They sit outside the unitary plan i.e. the Resource Management Act. Covenants are registered on title under the Property Law Act and the Land Transfer Act. For further discussion, see video below:
Key messages:
- If you have a covenants on your property, it will continue to apply despite zone change, say, under the upcoming changes.
- Private covenants could be changed with mutual agreement between the relevant parties.
- Some covenants may be time bound i.e., they fall off after some years. Covenants could be as simple as height of fence to complex as protection of high value bush.
